Tamil Nadu

In Tamil Nadu the instrument is a Rent Agreement (Lease Deed), the parties are called Lessor and Lessee, and the tenancy is read against the TN Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017.

Registration mandate

Section 4 of the RLRRT Act, 2017 requires EVERY tenancy - of any duration - to be registered with the Rent Authority within 90 days of execution. Registration fee is 1% of the consideration, with a floor of Rs. 1,000/- for residential tenancies.

How the cost is worked out

For a lease of up to 30 years, stamp duty is 1% of (total rent for the term + the security deposit).

Minimum stamp duty: 100

Local practice tips

  • Register with the Rent Authority on TNREGINET within 90 days; an unregistered tenancy cannot be enforced.
  • Deposits are conventionally 3 to 6 months of rent for residential premises.
  • Disputes go before the dedicated Rent Court, not the ordinary civil court.
