Gujarat

In Gujarat the instrument is a Rent Agreement (Lease Deed), the parties are called Lessor and Lessee, and the tenancy is read against the Gujarat Rent Control Act, 2011 read with the Gujarat Stamp Act, 1958.

Registration mandate

Under Section 17 of the Registration Act, 1908 a lease of immovable property from year to year, or for a term exceeding 11 months, must be compulsorily registered. Shorter terms may be registered voluntarily.

How the cost is worked out

Stamp duty is 1% of (total rent for the term + the security deposit).

Minimum stamp duty: ₹100

  • e-Stamp certificates are issued through GARVI and SHCIL branches.
  • Registration fee is capped at Rs. 30,000/- in Gujarat.
