Delhi

In Delhi the instrument is a Rent Agreement (Lease Deed), the parties are called Lessor and Lessee, and the tenancy is read against the Delhi Rent Control Act, 1958 read with the Indian Stamp Act, 1899 (Delhi amendment).

Registration mandate

Registration is compulsory once the term reaches 12 months. Fee is 1% of the total consideration plus a Rs. 100/- pasting charge.

How the cost is worked out

For a lease of under 5 years, stamp duty is 2% of the average annual rent (plus the security deposit where the deposit is treated as an advance).

Local practice tips

  • Most Delhi tenancies are drawn for 11 months precisely to stay outside compulsory registration.
  • Both parties plus two witnesses must attend the Sub-Registrar in person for registration.
  • Buy the e-stamp only from SHCIL or an authorised collection centre - loose stamp papers are not accepted.
